So my doctor primary care physician disclosed to me two 2024 years ago that I am CKD 3a.
She failed to mention to me that my kidney function was diminishing years prior to her disclosure in 2024.
Can I file a lawsuit and are there any legal personnel who would take on a case for the doctors negligence?
Yes. If I are informed earlier, we or I could started the process of getting a nephrologist on board, started talking kidney medication to slow down the degression, we could have also got the dietitian on board. All of these treatments I could have stated years ago if she would have said your kidney function is starting to diminish. You need to see a nephrologist.
I’m not an attorney, but suing might be difficult—can you prove that not being advised of past kidney function damaged your health, and can you prove that you weren’t told? This could come down to your word against your doctor’s.
At Stare 1-3 we might not have any symptoms or ill effects. My doctor has never told me l have CKD and l ended up being hospitalized in a third world country with 20% kidney function (this would have been good to know before l traveled); however, when l got home and looked at a past printout of an office visit, CKD was included. I had never read the entire report so didn’t know. Hr should have mentioned it, but suing him wouldn’t do any good and would be expensive, stressful, and not good for my health.
That sounds incredibly frustrating, and it's completely understandable to feel let down when you weren't kept in the loop about something as important as your kidney health.
While this is a deeply personal and serious concern, it falls outside the scope of health guidance that can be offered here. For legal questions like Show Full Answer
